By accessing or using the IGOpeople service, you signify that you have read the following terms and conditions (“Terms of Service”, “terms of use” or “agreement”) and accept and agree to be bound by them whether or not you register with IGOpeople. Where applicable under law, these terms constitute a “writing signed by you”. We reserve the right, at our sole discretion to change, modify, add, or delete portions of these Terms of Service at any time without further notice. If any modification is unacceptable to you, you shall stop using the IGOpeople service. Your continued use of the IGOpeople service will constitute your binding acceptance of the change.

Eligibility

Use or membership in the Service is void where prohibited. The sites purpose and focus is intended for users who are (18) years or older, though maybe accessed by persons below this age guideline. By using the Service or the Site, you represent and warrant that you are 13 or older and you agree to abide by all the terms and conditions of the agreement. You should provide true, accurate and complete registration information to be an IGOpeople member (user), and also maintain the accuracy of the information. As part of the registration process, you will be asked to select a user name and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, that is or may be protected by trademark or proprietary right law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.

Member Conduct and Appropriate Content

You understand that except for organisation publishing the service and the site are available for your personal, non commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory or otherwise unlawful material. You may not use the IGOpeople service for any illegal or unauthorized purpose. International users agree to comply with all local rules regarding online content and acceptable content, including laws regulating the export of data from the United States or your country of residence. You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links and other content (“materials”) that you submit, post and display on the IGOpeople service.

We may, but shall have no obligation to, remove or limit access to materials originating from any IGOpeople user that we determine in our sole discretion are unlawful, fraudulent, threatening, libellous, defamatory, obscene or otherwise objectionable, or infringes or violates any party’s intellectual property , including copyright, trademark, privacy, publicity or other personal or proprietary rights. Under no circumstances does IGOpeople have any obligation to check the accuracy or truthfulness of any materials, nor to monitor any members (“users”) use of the IGOpeople service.

You agree to abide by all applicable local, state, national and International laws and regulations and are solely responsible for all acts or omissions that occur under your account made by you including the content of your transmissions through the IGOpeople service. In addition you agree not to use the Service or the Site to;

• Solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes.
• Defame, abuse, intimidate, harass, stalk, threaten or otherwise violate the rights (such as rights of privacy and publicity) of others.
• Upload, publish, distribute and/or disseminate any harmful, obscene, indecent, unlawful, libellous, profane, defamatory, infringing, inappropriate, hateful, or racially, ethnically or otherwise objectionable material or information that would violate any local, state, national or international law.
• Use the Service or the Site in an unlawful manner or in any other manner that could damage, disable, overburden or impair the site.
• Transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, canel bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• Use or attempt to use another’s account, service or system without authorisation from the company, or create a false identity on the Service or the Site.
• Harvest of collect email addresses or other contact information of members (“users”) including usernames, from the IGOpeople Service by electronic or other means. Upload, post, transmit, share or otherwise make available any unsolicited or unauthorised advertising, solicitations, promotional materials, “junk mail”, “spam” , “chain letters”, “pyramid schemes” or any other form of solicitation.
• Impersonate any person or entity, falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity.
• Do not inhibit, restrict, another persons enjoyment of the site.
• Misuse any of the editing functionality on the site.

Proprietary rights

IGOpeople does not claim any ownership rights over your user content “materials” that you post, or display, on or throughout the site. You retain full ownership of all of your user content and any intellectual property rights or other proprietary rights associated with your user content. By submitting, posting or displaying any materials on or through the IGOpeople service, you hereby grant IGOpeople and its agents and assigns a limited licence to use, modify, publicly perform, publicly display, reproduce, and distribute such content (“materials”) solely in connection the IGOpeople service or the promotion thereof. You represent and warrant that the posting of your content (“materials”) on or throughout the IGOpeople service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any other person. You may not post, or transmit user content on the site or service that you did not create or that you do not have permission to post. You understand and agree that IGOpeople may, but is not obliged to, review the site and may delete or remove (without notice) any site content or user content in its sole discretion, for any reason or no reason, including user content that in the sole judgement of IGOpeople violates this agreement, or which might be offensive, illegal, or that may violate the rights, harm, or threaten the safety of users or others.

Privacy and Personal Information

It is IGOpeoples policy to respect the privacy of its members (users). IGOpeople will not monitor, edit or disclose any personal information about you with your prior consent. In order to run the IGOpeople service or site we have outlined below the the type of information we collect from you;

Information collected on the IGOpeople service

• We collect personally identity information such as your name and email address. This information is needed to set up a personal profile. As part of your personal profile you may be asked to submit other additional information.
• IGOpeople receives and stores information which is transmitted automatically from your computer and use of the IGOpeople service. This information includes information from cookies, your IP address and browser type. We collect information about how you interact with the IGOpeople service.

We will not rent or sell any data which may be personally identify you to any third party.

We may aggregate your data for disclosure to organisations for marketing purposes. By way of example we may disclose to an organisation with no representatives on IGOpeople that 40 people have posted on their organisation page but in such an event we undertake to ensure that all such data will be public on IGOpeople.com

Certain data such as your password will never be disclosed. You are responsible for keeping your password confidential and for all activities that occur under your password or account. Please inform IGOpeople on the IGOpeople Organisation page or at enquires@igopeople.com if there is any unauthorised use of your password or any breach of security.

By joining the IGOpeople service you agree to allow IGOpeople to communicate with you via email regarding IGOpeople digest feeds. These digest feeds will provide you with a summary of the activity on the IGOpeople site.

Copyright policy and complaints

You may not post, modify, distribute, transmit or reproduce in any way any copyright material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. When we receive a proper notification of alleged copyright infringement and confirm its legitimacy we will promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeat infringers. If you believe that your work (or the work of a third party on whose behalf you are entitled to act) has been copied in a way that constitutes copyright infringement, please file a copyright infringement notification (notice) with us, by sending a written communication or email communication which should include the following information;

• Statement that you have identified material on the IGOpeople service which infringes your copyright (or infringes the copyright of a third party on whose behalf you are entitled to act, if applicable) If you do represent a third party you must prove that you can speak on their behalf.
• A description of the copyrighted work or other intellectual property that you claim has been infringed.
• You should give a description of where the material that you claim is infringing is located on the site and how it has been infringed. You should give a url address or and a screenshot.
• The country or countries to which the copyright applies.
• Your email address, telephone number and physical address so that we can contact you.
• The contact details that you would like us to provide to the alleged infringer so that they may contact you directly to address and resolve the complaint.
• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
• A statement by you that you have good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement by you, made under penalty of perjury, that the above information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owners behalf.

IGOpeople and its affiliates disclaim any responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information, content or materials displayed on the IGOpeople service.

Dealings with Groups or Organisations

Your correspondence or dealing with groups or organisations found on or through the IGOpeople site or service is solely between you and the group or organisation. You agree that IGOpeople shall not be responsible or liable for any loss or damage of any sort incurred as the result of such dealings or as a result of the presence of the groups or organisations on the IGOpeople service.

Limitation of Liability

YOUR USE OF THE IGOPEOPLE SERVICE IS AT YOUR SOLE RISK, UNDER NO CIRCUMSTANCES WILL IGOPEOPLE, ITS DIRECTORS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, SUPPLIERS OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL,USE, DATA, OR OTHER INTANGIBLE LOSSES) INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF OR CONDUCT ON THE IGOPEOPLE SERVICE, OR YOUR MATERIALS, INCLUDING ANY LIABILITY OR EXPENSE ARISING FROM ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES (ACTUAL AND CONSEQUENTIAL), JUDGEMENTS, SUITS, LITIGATION COSTS, ATTORNEYS FEES, AND EXPENSES OF EVERY KIND AND NATURE.

ALTHOUGH RIGOROUS PROTOCOLS ARE APPLIED TO THE IGOPEOPLE SITE OR SERVICE, IGOPEOPLE DOES NOT MAKE ANY WARRANTY THAT THE IGOPEOPLE SITE OR SERVICE IS FREE FROM INFECTION BY VIRUSES OR ANYTHING ELSE THAT HAS CONTAMINATING PROPERTIES.

IGOPPEOPLE DOES NOT ACCEPT ANY LIABILITY FOR ANY LOSSES OR CLAIMS ARISING FROM ANY INABILITY TO ACCESS THE IGOPEOPLE SITE OR SERVICE.

INDEMNITY AND WAIVER

You hereby agree to indemnify and keep indemnified IGOpeople.com , its subsidiaries and affiliates, and each of their directors, officers, employees and agents from and against any and all liability, damages, losses, claims, demand, damages, costs and expenses, including reasonable legal fees resulting in any way from your use of and from material posted on the site or through your use of the service, your conduct in connection with the service or the site or with other users of the service or the site, or any violation of this agreement or of any law or the rights of any third party.

SUBMISSIONS

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or any other “submissions” to “recipients” (IGOpeople Ltd or other groups and organisations on the IGOpeople site or service) which may improve their products, services, or offerings shall become the sole property of the recipient unless otherwise stated, displayed or disclosed by the recipient of your “submission/s”. The “recipients” shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to you.

Termination of the IGOpeople service

You agree to remain bound by this agreement (or such amended agreement) for as long as you remain a user or member of IGOpeople. In the event that user or member expressly requests to leave IGOpeople, no further communication will be entered into between IGOpeople and the user or member. The users or member acknowledges that even if his or her account is terminated, he or she may receive emails from IGOpeople.com for a period of thirty days thereafter.

Validation of Organisation Accounts

IGOpeople Ltd holds the right to automatically convert all organisations (Business, governments, NGOs, NPOs) which are set up under an individual account on IGOpeople.com , or any individual who conveys that they are speaking on behalf of or representing an organisation to an organisation account on IGOpeople.com as IGOpeople Ltd validates all organisation representatives on IGOpeople.com. All organisation accounts on IGOpeople.com have validated representatives to give comfort to the community that a person who represents an organisation is from that organisation. While IGOpeople Ltd undertakes a manual process to ensure that this process is 100% accurate we cannot be held responsible for errors in this process. In the event that you believe that an organisation representative is not from the organisation represented please notify IGOpeople Ltd via the “report abuse” button at the end of each page. Please also submit your contact details so that we can contact you.

Distance Selling Directive Policy

If you terminate IGOpeople service within 14 days of first payment, IGOpeople will refund your subscription within 30 days without penalty (right of withdrawal)

In the event that user or member expressly requests to leave IGOpeople, no further communication will be entered into between IGOpeople and the user or member. Any fraud or abuse of the IGOpeople site or service may result in the immediate termination of the user or members account.
